Spousal support is available for those who qualify for such relief under North Carolina law. To be eligible for spousal support, one must prove that he or she qualifies as a “dependant” spouse and that the other spouse qualifies as a “supporting” spouse. Temporary spousal support or “post-separation support” is designed to provide a spouse with financial assistance while the parties attempt to resolve issues related to the distribution of assets, liabilities and income. Generally speaking, the court is required to consider the income available to each party as well as the reasonable, necessary and ordinary expenses of each party when setting the amount of support to be paid. The period of time that one spouse might be required to provide the other spouse within financial assistance is within the discretion of the court.
