Post-marital Agreements

North Carolina recognizes the right of married persons to enter into contracts regarding the disposition of their property so long as said agreement is not inconsistent with public policy. In contrast to a pre-marital agreement, post-marital agreements are limited to agreements regarding the distribution of property. In contrast with a pre-marital agreement, purported waivers of spousal support contained in a post-marital agreement are not enforceable.
