Judgment of Absolute Divorce

The legal instrument which dissolves a marriage is a judgment of absolute divorce. Either party may apply for a judgment of absolute divorce once the spouses have lived separate and apart for one year. To be eligible to file in North Carolina, one or both spouses must have been a resident of this state for a period of six continuous months.
